Meanwhile, Republican gubernatorial candidate Dick DeVos has failed to convince us that he has the answer to Michigan's economic problems.

Although he was successful running the Amway organization founded by his father, we disagree with the notion that having a background in business translates into knowing how to run state government.

And we're perplexed by his pledge to increase investment in education without increasing taxes or gutting other state programs that have been trimmed repeatedly already.

That's why the Kalamazoo Gazette is recommending voters return Gov. Granholm to office for a second and final four-year term.

Mannatech Says No Contact With Attorney General

Mannatech Inc., a Coppell-based maker of nutritional supplements, said Monday it has not been contacted by the Texas attorney general's office regarding an investigation into the company's alleged activities.

On Friday, the attorney general's office sent out a nine-page memo with information on a probe launched over health claims made about the company's products.

News of the probe sent the company's stock plummeting, losing 16.54 percent. Shares regrouped a bit Monday, gaining 63 cents, or 4.2 percent, to close at $15.57.

Quixtar Will Not Be Announcing Sales Data

As predicted, I am about to have a field day with this news. Quixtar sales are obviously not very good so they are delaying the reporting of their sales until after the Christmas season.

Watch for HUGE promotions in the next 2 months so that Quixtar might crawl out of their hole.

In the past, Quixtar's answer to poor sales growth was to raise their prices. Quixtar does not appear to be taking that tactic this time, which is good news for IBO's who already struggle with some of the highest priced products in the industry.

In past years, Quixtar has typically announced its annual sales in October based on the September 1 to August 31 performance year established for Independent Business Owners (IBOs).

While the company has not changed the timeframe for which it recognizes IBO achievements, it has changed its own financial reporting schedule as part of a larger shift made by parent company Alticor Inc. For tax reporting reasons, the companies now follow a calendar year for reporting financial performance.

As a result, Quixtar will not announce its corporate financial performance until after the New Year.  At that time the company will announce sales for 2006 calendar year as well as sales reported for September through December 2005.  After that, sales will be reported for each calendar year (which would not necessarily correspond with the IBOs' performance schedule).

Texas Attorney General Anticipates Filing A Suit Against Mannatech

An Oct. 24 memorandum in response to a public information request says the state's top cop has "anticipated filing suit against Mannatech" for a number of alleged violations.

The public information request was filed by someone who has sold short Mannatech's shares.

The memo further states that the company has been under investigation by the attorney general's Consumer Protection and Public Health Division since July 2005 regarding possible violations of the state's Deceptive Trade Practices Act "and other related consumer protection statues."

Subsequently, the Texas Department of State Health Services contacted the attorney general's office "with similar concerns..." Among those concerns, the memo says, are "unproven health claims" allegedly made by Mannatech about its products, "such as the ability to cure or treat cancer" and other ailments.

"The claims being made are not approved by the Food and Drug Administration, making the claims potentially in violation of both state and federal law," the memo says. "There is also concern that Mannatech does not disclose certain health risks associated with its product."
