Univera Lawsuit: Company Sued By Former Top Distributors

Univera DENVER, June 25 /PRNewswire/ -- It's a lawsuit that may help determine "who owns who" in the world of multi-level marketing. According to John Terhune, one of the plaintiffs who filed suit in state court in Volusia County, Florida, today, "The last thing we wanted to do was get involved in litigation. All we wanted to do was build businesses and help others do the same."

Terhune, along with former Univera leaders Marshall Douglas and Joe Land, are former distributors of Univera who have joined together in a lawsuit alleging the company has bullied its associates with threats of litigation and economic ruin if their sales networks move to a competitor. The filing comes on the heels of two actions Univera filed against them in Seattle earlier this year.

Terhune and his fellow plaintiffs spent years building their multi-level marketing network into a thriving family business. As a distributor of Univera products, Terhune, Douglas, and Land managed a vast network of associates, many of whom they personally recruited. For several years all three enjoyed a great relationship with Washington state-based Univera, a company known for its popular dietary supplements. Univera recognized Terhune as its Associate of the Year in 2007 and bestowed the Yun Ho Lee Award, Univera's most prestigious leadership and sales award, on Terhune in 2008.

But in 2007, poor management decisions destroyed what had been a promising business opportunity. Univera sacked its flagship product, Ageless Xtra, and replaced it with a "fizzy" liquid supplement called Xperia. The new product, quickly developed a reputation for "exploding" in its packaging and arriving in "soaked boxes." During the same time, the company swapped out its computer platform with great fanfare. It turned out to be a disaster. The new internet applications failed and a flood of customer complaints soon overwhelmed the Univera system. Customers, associates, and profits began to disappear.

In the span of just a few months, Univera squandered years of its associates' hard work and goodwill. Terhune, Douglas and Land had had enough. They transferred their remaining Univera business to their spouses, and began building a new network with another company.

Orrin Woodward's TEAM Analysis II

In my last post, I talked about how Orrin Woodward's TEAM would might see great success in a Network Marketing Binary Compensation plan.

However, I should also point out that the TEAM concept (again slightly modified) would work well (perhaps better in the long run) with a Unilevel compensation plan as long as there are some additional depth bonuses. (Univera has this type of plan.)

The Unilevel plan is considered (by many) to be the most fair plan for the average person.

In the case of Univera's compensation, the added depth bonuses (called generational bonus) allows an associate to be paid (2 to 14%) as far down as six diamond level organizations in depth.

Imagine someone from the TEAM who used to spend $300/month to make 100PV, now spending $125/month to make 100PV, with every person (on their team) netting out a larger check bonus check. That is the potential of a new plan for the TEAM.

Rich Razgaitis Promoted to President, North America for Univera

Univera:

Univera announces the promotion of Rich Razgaitis from Executive Vice President of North America to President, North America, effective immediately. In this role he will continue to report to CEO Stuart Ochiltree. This promotion is a result of the significant growth of Univera business in North America as well as the acknowledgment of Rich’s noteworthy achievements in catalyzing that growth since he joined the company in January 2006. The promotion is also a reflection of an expanded role for the Sales and Marketing Departments with regard to global sales and marketing strategies.

Rich’s promotion was deemed a judicious move by ECONET® and Univera CEO Stuart Ochiltree who states: “Rich has been instrumental in taking Univera’s sales and marketing endeavors to a whole new level. The synergism of Customer Care with Marketing and Sales makes it imperative that one individual oversee the North American operation—and I have every confidence that Rich Razgaitis is capable of the job. Additionally during his tenure as EVP of North America,  Rich was responsible for the extraordinary achievement of leading a significant and successful re-branding of the company from the ground up; this, coupled with devising business initiatives, including additional—and vastly improved—sales materials, has given our Company the platform necessary for global growth and sustainability.”

Razgaitis holds a BA in Marketing and an MBA in General management from Anderson University, Indiana. He comes from a diverse business background in which he’s been involved in complete corporate turnarounds. He has led campaigns to position, brand and bring to market product lines for companies ranging from venture capital backed start-ups to such Fortune 500 icons as Johnson and Johnson and Eli Lilly, generating significant revenue growth for each.

With Razgaitis assuming the role of President, Chief Scientific Officer Stephen Cherniske will have more time to continue his valuable research and product formulation work—constantly keeping Univera in the forefront of ethnobotanical discovery, and its application to bringing the best of nature to humankind. This change will also allow Stephen to continue to represent Univera as a sought-after spokesperson—a role he assumed when he joined the company in 1999.
