Success University Joins "Feed The Children" To Help Aid Hurricane Katrina Victims

Evolv Misusing MD Anderson to Promote Evolv Neutraceutical Water?

Wow...a pre-launch Network Marketing MLM using hype and half-truths to promote their company. That's unheard of!

Evolv neutriceutical water From Science Blogs:

The premier US cancer hospital and research center in Houston released a statement today distancing themselves from a Dallas company claiming an endorsement of their water product by The University of Texas M.D. Anderson Cancer Center:

Recently, you may have heard or read about a company that sells Evolv, a "nutraceutical beverage," which is being promoted in part based upon testing done at The University of Texas M. D. Anderson Cancer Center, but also is being mistakenly viewed as endorsed by M. D. Anderson. M. D. Anderson conducted limited chemical analysis of the product to evaluate its anti-inflammatory activity for a fee at the request of the manufacturer. No efficacy or toxicity data were generated at M. D. Anderson nor was the product tested on humans. Moreover, M. D. Anderson does not have any involvement with the company, the product is not produced by M. D. Anderson, and M. D. Anderson does not endorse the product or recommend its use.

The current text on Evolv's website is that:

Evolv's nutraceutical beverage with Archaea Active is tested by M.D. Anderson Cancer Center in Houston, Texas.

The statement as listed is not exactly wrong; it's just not complete. Nothing there about what the product was tested for, but the implication is that it gained some healing power by passing through the hallowed halls of M.D. Anderson. I also have no clue as to whether it was tested for archaea (formerly archaebacteria) or if it has the capacity to amplify DNA.

Anti-ageing priority at Nu Skin in Asia

Nu Skin seems confident of growth in Asia with new "Anti-Ageing" image.

Sep 07, 2009 (Bangkok Post - McClatchy-Tribune Information Services via COMTEX)  Nu Skin Enterprises, the US-based direct-selling business, will redefine itself as anti-ageing company after what it says is the biggest discovery in its 25 years, with new products to meet the needs of the rising population of older people globally.

Dan Chard, the company's president of global sales and operations, said during a Bangkok visit last week that Nu Skin had been defined as a supplement and personal-care products company. But from now on it will be known as an "anti-ageing firm".

Despite the poor economy and rising unemployment, the business of Nu Skin remains healthy with global sales up 4 percent to US$322 million in the second quarter of this year. This is because more people have turned to direct selling to earn additional income.

Polaris Media hires Wilkinson PR for crisis management

With the official launch of Polaris Media group just hours away, it seems the company has gone into a massive scale crisis management.

Things haven’t gone as smoothly as the company’s head honchos would have liked. Polaris Media Group advisors are running around issuing legal threats, the NSW government have declared Liberty League to be a pyramid scheme, job networks are refusing to list Polaris ads and a Whirlpool Australian community forum thread is thriving with over 2000 replies where Australians are discussing Polaris Media openly.

In addition to ordering a complete media blackout for Polaris Media Group associates, the company has also recently enlisted the services of Australian public relations company, Wilkinson PR.

Monavie trys to sue Blogger

For those who don't know, MonaVie is a juice, that retails for $1.70 an ounce (yes ounce). Being the consumer advocate that I am, I wrote that I think MonaVie is a scam since it's around $1500-$2000 a year per person and has no proven health benefits. (In fact, only people associated with MonaVie even allege that it's healthy and never address that for less money you could buy healthier foods.) My critical article has been pretty popular, somehow gathering a few devoted followers who have added new research on a daily or weekly basis. That has helped it rank on the first page of Google for the company's own term, "MonaVie".

With that in mind, MonaVie sent me a cease and desist on the article. It's not really a surprise to me, as I'm sure have this criticism in such prime real estate as Google is not good for their business. In fact, I'm proud that my criticism is apparently costing them enough sales where they feel they need to do something (however far-fetched) to shut me up.

Here's the e-mail that they sent to the company that does the private registration on my domain:

Subject: Trademark Infringement

Dear Domains by Proxy, Inc.:

MonaVie LLC (MonaVie) has been informed of the website(s) http://www.lazymanandmoney.com/monavie-scam-was-my-wife-recruited-sell-snake-oil/ registered through Go Daddy Domains. As the registrant, MonaVie asks that you remove all references to MonaVie and its products.

As a network marketing company MonaVie does not permit its name to be used in any URL or email address and the company must take necessary action to protect its intellectual property. It is not permitted for a third party vendor to use the MonaVie trade name in any form.

The MonaVie name and symbol are registered trademarks. (U.S. Reg. Nos. 3111333, 3111332, 78526279). MonaVie's federal registration of these trademarks provides MonaVie with the right to restrict the use of the trademark, or a confusingly similar trademark, in any way that misrepresents the origin of MonaVie's products or dilutes the MonaVie brand and goodwill associated therewith.

State and federal law supports our position that the use of MonaVie's trademarks and proprietary copyrighted material may cause confusion among customers. This confusion may cause substantial harm to the trademark by facilitating the loss of its effectiveness in establishing a distinct association between it, MonaVie's products & services, and MonaVie's goodwill. Your unauthorized use of MonaVie's federally registered trademarks amounts to an infringement of MonaVie's trademark rights.

MonaVie wishes to settle this situation amicably and therefore, requests that you immediately cease the use of our trade name MonaVie. Additionally, we request that you respond to this email within seven (7) days to confirm this action via email to: [Editor's note: e-mail address erased].

Failure to comply with our requests may result in legal recourse to protect our vested interests in the aforementioned trademarks and trade names. Should you have any questions, please contact me at the following number [Editor's Note: Phone number removed].

Utah Business magazine unveiled the winners of the second annual Fast 50 awards program, naming MonaVie (www.monavie.com), maker of premier acai-based nutritional and energy drink products, as the No. 1 fastest growing company in Utah.

Moxxor Top of MLMRankings for July 2009

MLM Startup Moxxor, headquartered in Aliso Viejo, California, topped out the July update from MLMRankings.com as the home business with the highest gain in consumer interest and awareness for the month.

With an impressive 11.84% gain over the last metrix period, Moxxor and their flagship product - an antioxidant derived from Green Lipped Mussels and Grapeseed extract - outpaced competitors to take the top spot.

Moxxor has a national launch event scheduled for the fall in Orange County, CA.

Evolv appoints Anne Bodak as VP of Sales
